by | Mar 15, 2023 | SSA Case Study Examples of Hearings and Outcomes

60-Year-Old Male from Miami, Florida with an Alleged Onset Date of November 2020 and With a Date Last Insured of 12/31/2023.

The claimant has a prior Unfavorable Decision dated August 21, 2020, where he was unsuccessfully represented by a different law firm. The ALJ at that time found the claimant could perform full range of medium work and thus he was denied at step 4 of SSA disability. At this step the Administrative Law Judge found the claimant could perform his past relevant work.

Special Grid Rules - Gonzalez & Goetz Disability

The Past Relevant Work was classified by the Dictionary of Occupational Titles as: Cook DOT # 205.281-010 (Light, Specific Vocational Preparation of 6, performed at the medium exertional level); Sous-Chef #987.161-010 (Medium, Specific Vocational Preparation of 8); Executive Chef # 987.161-010 (Light, Specific Vocational Preparation of 8, performed at the medium exertional level).

At the hearing we argued that the limitations of balance, stooping, kneeling, crouching, crawling as well as the need to avoid concentrated exposure to unprotected heights, extreme temperatures, and dangerous machinery precludes the claimants past relevant work.

This time with our help the claimant won his case under the special grid rules at 201.06 (sedentary work grids out the client)!
