54-Year-Old Female from Ellenwood, Georgia had a hearing in Atlanta, Georgia via telephone due to the COVID waiver completed requesting a telephonic hearing.
The claimant was 54 years old with AOD of 3/1/2020 and Date Last Insured of 9/30/2024. However, since the claimant returned to work full time in 2022, we had to amend the case to a closed period case encompassing the time period from 3/1/2020 to 12/31/2021.
Thus, at the hearing our attorneys pursued a closed period of disability from 3/1/2020 through 12/31/2021. During this time, the claimant had suffered a work-related injury where she fell and fractured her right hip and tore her ACL in her right knee.
After this injury, she was not able to walk or stand for very long despite localized injections and physical therapy. Additionally, there was a worker’s compensation claim filed with documentation of work restrictions (such as no lifting more than 10 pounds, walking/standing occasionally, no bending or squatting). Our attorney successfully argued that the claimant was reduced to a sedentary level during the closed period of disability-under which she would grid out.
